These terms govern your use of the ESMA International Network website and mobile app. By accessing or using either, you agree to be bound by them. If you do not agree with any part of these terms, please stop using the site.
In these terms, “ESMA”, “we” and “us” mean the ESMA International Network, a non-profit membership organisation registered at 1 Shields Court, High Wycombe, HP10 8JU, United Kingdom.
This website is provided for information about the ESMA International Network and for use by our current and prospective members. You agree to use it only for lawful purposes, and in a way that does not infringe anyone else’s rights or restrict their use of it.
You must not attempt to gain unauthorised access to any part of the site, to any account that is not yours, or to the servers on which it runs. You must not use the site to distribute malware, to send unsolicited commercial messages, or to collect other members’ details for marketing purposes.
We may change, suspend or withdraw any part of the site at any time. We aim to keep it available but we do not guarantee uninterrupted access.
Membership of the ESMA International Network is subject to application and approval. Submitting an application does not create a membership, and we may accept or decline an application at our discretion.
If you are given an account, you are responsible for keeping your login details secure and for everything done using your account. Tell us immediately if you believe someone else has gained access to it. If your company account allows you to create additional logins for colleagues, you are responsible for the people you invite and for removing them when they no longer need access.
We may suspend or close an account that is used in breach of these terms, or where membership has lapsed.
Members can publish a company profile, including a description, logo, images, brands, categories and contact details. You keep ownership of everything you upload. By publishing it you grant us a non-exclusive, royalty-free licence to host, display and distribute that content as part of the network — on the website, in the mobile app, and in ESMA communications about the network.
You are responsible for the content you publish. You confirm that you have the right to use it, including any images, logos and trade marks, and that it is accurate and not misleading. Do not publish anything unlawful, offensive, defamatory, or in breach of anyone else’s intellectual property or privacy.
Where you publish a colleague’s name, photograph or contact details as a point of contact, you confirm that you have their agreement to do so.
We may edit or remove content that breaches these terms, or that we reasonably consider unsuitable, and we will tell you if we do.
The member directory is published so that members and the wider industry can find and contact each other. You may use it to make legitimate business contact. You may not scrape it, copy it in bulk, or use the details in it to send unsolicited marketing, and you may not pass those details to any third party for that purpose.
Registering interest in an event does not by itself guarantee a place. Details of events, including dates, venues, speakers, programmes and costs, may change, and events may be postponed or cancelled. Where a booking involves a payment, the terms and any cancellation or refund conditions given at the time of booking apply.
Some documents, reports and event materials are made available only to signed-in members. They are provided for your own business use. You may not republish or redistribute them outside your organisation without our permission.
The ESMA name, logo, and the design, text, graphics and software of this website and app belong to ESMA or to our licensors, and are protected by copyright and trade mark law. You may view, download and print pages for your own reference or for legitimate business use within your organisation. You may not otherwise reproduce, adapt or commercially exploit any part of the site without our written permission.
The site links to member websites, event organisers and other third-party services, and may embed third-party content such as videos and maps. Those sites and services are outside our control. We include the links for convenience and we are not responsible for their content, their availability, or their privacy practices.
We take care to keep the site accurate and up to date, but much of its content — including member profiles, brands and contact details — is supplied by our members, and event details are supplied by organisers. We do not warrant that everything on the site is complete, accurate or current, and you should verify anything you intend to rely on.
Nothing on this site is professional, legal or commercial advice, and it is not an endorsement of any member, product or service.
The site is provided “as is”. To the fullest extent permitted by law, we exclude any implied warranties about it.
We are not liable for indirect or consequential loss, or for loss of profit, business, goodwill or data, arising from your use of the site. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Our Privacy Policy explains what personal data we collect and how we use it. It forms part of these terms.
We may update these terms from time to time. The date at the top shows when they were last changed. Continuing to use the site after a change means you accept the updated terms.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them or from your use of the site.
